1. general
For all transactions between the Tyrolean snowboard school boardbetter and the customer, our terms and conditions apply, unless expressly agreed otherwise in writing. The object is the operation of a snowboard school, alpine division, with the related services, in particular the provision of instruction and instruction in the skills and knowledge of snowboarding, guiding and accompanying on slopes, in open snowboard areas and on snowboard tours and coaching and training. A concrete training success can not be legally guaranteed
2. conditions of participation
Customers and participants of boardbetter’s services are required to inform the snowboard school about their abilities and experiences in snowboarding as well as any health complaints, fore-right injuries or illnesses as well as pregnancies unsolicited, truthful and comprehensively before the beginning of the service. In the case of children and minors, this information obligation is met by the parent or guardian making the reservation. The snowboard equipment used, in particular the function of the safety binding, must be independently checked by the customer before the service is used by a specialist company. In the case of minors, the legal guardians must ensure that the snowboard equipment is expertly checked. For minors there is general helmet duty. Disregard of instructions and warnings regarding the safety of customers entitle the snowboard school boardbetter immediately to the contract termination. This also applies if customers participate in the services of boardbetter under alcohol, drug or medication impairment as well as in the case of improper conduct of the customer, especially towards other students. Group courses are held from a minimum of 4 participants. If this number of participants falls below, boardbetter reserves a reduction of the booked course hours. The group division is exclusively for the snowboard school boardbetter.
3. offer, prices, contract
The snowboard school boardbetter reserves itself at any time changes regarding the offer and program as well as the pricing. For errors and mistakes on printed matter as well as in online and website offers no liability is accepted by the snowboard school. Reservations can be made by phone or by email and will not be valid until confirmed in writing by boardbetter. The offers are non-binding. All prices are quoted in Euro and include 20% VAT. The cost of lift tickets and snowboard equipment are not included in our prices unless otherwise expressly stated in writing.
4. terms of payment
For bookings and reservations, a deposit of 50% of the total booking costs must be paid 7 days upon receipt of the booking confirmation, unless the snowboard school boardbetter explicitly waives the written form.
Residual payments must in any way be received in our bank account at least 10 bank days before commencemend of the reserved service. Otherwise the snowboard school reserves the fulfillment of the service.
In case of cancellations the following conditions apply:
In case of illness or injury of the respective participant, no cancellation fees are due on presentation of a medical certificate. For cancellations for other reasons up to 10 days before the start of the booked service, a processing fee of € 30, – will be charged.
For cancellations made 10 days or more before the start of the booked service, 50% of the total price of the service, and 3 days before the start of the service will be charged 100%.
If, when booking off-piste offers in private coaching, freeriding or splitboardtours, the performance is not acceptable or possible according to the estimates of the guides or the snowboard school leader due to the respective snow or dangerous situation, the snowboard school boardbetter offers a replacement program on slopes. This is to be accepted by the customer for the price of the snowboard technique – lessons for a period of one day as a replacement.
boardbetter is trying to provide goodwill, but there is no legal claim to it.
5. liability
The practice of snowboard sports also carries a risk of injury in the context of snowboard school services. The snowboard school boardbetter and its instructors and snowboard instructors are not liable for accidents, but only for damage caused intentionally or grossly negligent and only in the immediate context of the respective service. The snowboard school bears no liability for any other damages, especially those outside of course and supervision times. The conclusion of their own corresponding accident, liability, recovery and recovery insurance is the responsibility of the customer or participant.
6. warranty
Any complaints must be made immediately and immediately upon arrival of the release on site in the snowboard school office or by telephone, so that the snowboard school has the opportunity to remedy the situation. Boardbetter strives for solutions and goodwill, however, there is no right to a reduction in compensation or compensation in case of delayed notification. Any legitimate claims of customers to boardbetter must also be made in writing and justified at the latest four weeks after their occurrence. Courses, coaching and guiding take place basically in all weather conditions. In the event of events not within the control of the snowboard school boardbetter and which lead to the restriction, reduction or total failure of services such as storm, failure or limitation of the lift operation or partially or total lack of snow, there is no legal claim of the customer for refunds or compensation of any kind.
7. jurisdiction
For all disputes, regardless of the nationality of the customer and the place of damage, the place of jurisdiction Kufstein as well as exclusively Austrian law.
